Descendants of John Westaway & Mary Cory of Bradworthy, Devon

During the late 1860's one Reverend John Robert Powell, used various parish registers from North Devon & Cornwall to produce his work, "Notes on Devonshire & Cornwall parishes & families". This was done by candlelight and he was responsible for ruining the Bradworthy parish registers with candle wax. However, his pedigree for the Westaway family clearly states that they originated from one Mark Westaway of Inwardleigh. The Rev. Powell would have been able to question living Westaways dwelling in Bradworthy at that time and the Mark & Inwardleigh plus the progenator, John Westaway's age when he died, would prove almost certainly that this John was the son of Mark Westaway & Elizabeth Parr. At least eight of these grand children emigrated to Canada where many more descendants were brought into the world (these are highligted with the Canadian flag)

She was born 1761 in Bradworthy, Devon, Eng, and died 1848 in Bradworthy, Devon, Eng. Below is John's will which mentions many of his descendants.

Proved 11 February 1837 In the name of God, Amen. I, John Westaway , of the parish of Bradworthy and County of Devon, do make and ordain this to be my last Will and Testament,and as touching such worldly things wherewith it hath pleased God to bless me in this life, I hereby give bequeath and dispose of the same in the following manner & form. First I give to my son Francis the sum of Six pounds. Also I give to my son William the sum of twelve pounds. Also I give to my Daughter Elizabeth the Sum of Six pounds. Also I give to my Daughter Athalia the sum of Six pounds. All the above given Legacies shall be paid by my undernamed Executors in twelve months after my decease. Also I give to my son-in-law, Richard Walter , all the Fee Simple and Inheritance of all that field or close of land called or known by the name of North South Hill Marsh , part of Drews Tenement in the parish of Bradworthy , To him and his heirs and assigns for ever with the power of doing with it what he may think proper, And shall not be subject to the payment of Church-rates, poor Rates, nor Highway rates for ever for the said Close of Land. Also I give to my beloved Wife Mary Westaway the Sum of twelve pounds yearly, and every year during her life Six pounds of which to be paid her out of Drews Tenement after North South Hill Marsh is taken from it and other reserves as below, and the other six pounds to be paid her out of my Estate called Honnacotts both situate in the parish of Bradworthy . This request shall be paid her quarterly if demanded, and in case of any defaulter or neglect of payment for more than a quarter of a year of a quarter's payment after my decease becoming due, I hereby authorize and empower the said Mary , or by her attorney, to distrain upon the goods and chattels on each of the said Estates above named for the recovery of the quarterly payment of the annuity above given, as often as the case may require. Also the house called Crumbs in the village of Bradworthy town, Together with a Garden and Orchard adjoining, with a right of Common on Bradworthy Moor , so long as the said Mary shall happen to live. Also as much and as many of my household goods as she may think proper to take, but not to exceed the value of seven pounds. Also I give to my son Mark All the Fee Simple and Inheritance of all my Freehold Estate called Drews Tenement , with a right of common on Bradworthy Moor situate in the parish of Bradworthy , Except that Field reserved to Richard Walter , and Crumbs house, Garden and Orchard so long as the said Mary Westaway shall live, to him and his heirs and Assignes for ever, with the power of doing with it what he may think proper subject to the payment of a sum of money as mortgage on the said premises and also subject to the discharging and paying of all Legacies and yearly annuities given out of it as within contained and also subject to the discharging and paying of all Church Rates, poor Rates and High-way Rates that the within named North South Hill Marsh shall be forever assessed in or subject to pay, but by default or neglect of payment of the several taxes and assessments justly levied on the above-named field of land I hereby author-ise and empower the Church Wardens, Overseers, and Surveyors of the highways of the parish of Bradworthy to distrain upon the Goods and Chattels found on the other part of Drews Tenement , for the recovery of payment as often as need shall require. Also I give to my two Grandsons, sons of Ann and John Westaway (namely) Benjamin Yeo Westaway and John Westaway , All the fee simple and Inheritance of all my Freehold Estate called Honnacotts jointly Except that field held on Mortgage by Christopher Harris , being part of the aforesaid Honnacotts with a right of Common on Bradworthy Moor , To them and their Heirs and Assigns for ever with their being under the control of guardian or Trust as within described. Also further subject through that trust to the payment of all Legacies and yearly Annuities which shall be above or within contained Together subject to the payment of a note of hand given by me to Mr. William Turner of Twenty pounds and Interest, and to Mrs. Gifford of Five pounds and Interest. Also I give my Grandson, Thomas Westaway , son of John and Ann Westaway , the sum of two pounds. Also I give to Mary, Athalia, Ann, Georgianna and Grace , All Daughters of the said Ann and John Westaway , the sum of two pounds each of them and to be paid them, all those six last given legacies out of my Freehold Estate called Honnacotts as above named..... John Westaway. ..As they shall severally arrive to the full age of twenty one years and I hereby nominate and appoint William Routly of Kilkhampton as Guardian and Trust for the within named Benjamin Yeo Westaway and John Westaway , sons of Ann and John Westaway . And I hereby authorise and empower him to receive all Rents and profits and to pay and discharge all yearly Annuities and Legacies as within bequeathed as they severally shall become due, before they are all paid and settled, and to transact all their business of whatever kind or nature it may consist of. Also I give to my son, John , All the fee simple and Inheritance of all the Great and Sheaf Tithe on my Estate above named called Honnacotts. Also the fee simple and Inheritance of All the Great and Sheaf Tithe of a field called Mill Park , near the village of Bradworthy Town , to him and his heirs and Assigns for ever, with the power of doing with it what he may think proper. Also a House called Yeo's house with two Gardens adjoining, and about three Quarters of an Acre of Land in the Middle part of a field called Mill park near the village of Bradworthy Town with a right of Common on Bradworthy Moor, so long as such right shall continue therein, subject to paying conventionary Rent and other Incumbrances lawfully imposed thereon. But in case my Wife, Mary Westaway, shall exact of the one third of the value of my land (If not Dower barred) to her own use and benefit, then in that case she shall not be Intitled to any part of the within bequeathed sum of twelve pounds a year. Also I give the fee simple and Inheritance of all my Freehold Houses and Lands which is not hereinbefore given to my son, Mark , and my two Grandsons called Benjamin Yeo Westaway and John Westaway , both sons of Ann and John Westaway jointly, To them and their Heirs and Assigns for ever. William Westaway was a teacher and a monumental mason. During the early and mid 1800's Bradworthy had a reputation for local scholars,who achieved a high standard in the "three R's" in particular the art of 'copper plate' writing. Some of the work that has survived both of teachers and pupils is superb. In the 1820's some of the farmers and business people in the neighbourhood were paying fees to William Westaway for "schooling and singing instruction". Examples of his ornate monumental inscriptions and designs can still be seen in Bradworthy Churchyard especially the Westaway family and I will attach these where applicable.

In William Westaway's poem home in 1866 or there abouts, William references his brother John as also being in Canada and working at mines in Ontario. He refers to him as being a "bearded man".
